Execution Case Highlights the Power of One Vote

Based on the New York Times in the article
http://www.nytimes.com/2015/01/26/us/in-taking-up-execution-drugs-case-justices-highlight-importance-of-a-single-vote.html occasionally when an inmate is waiting to hear whether their case is going to be heard or not by the Supreme Court as the justices vote on whether to let the inmate stay or be put to death they take a vote. it takes at least 5 votes for the inmate to stay the execution but only 4 votes for the court to hear the case. However if the inmates execution date is before the hearing of the case then the inmate will be executed before the hearing of the case, so is it really fair for the court to not give the person the extra vote to postpone the date because they want to hear the case anyways? This issue seems very serious not only because it seems unfair to the inmate but also because it seems unjust in the fact that the only reason the person is not getting a stay is because of one vote that is often given to the inmate as a courtesy but when it is not given it seems very unfair. I personally think that this is an issue that should defiantly be looked into because everyone deserves a fair trial and if they are not receiving a trial because of timing and pre determined dates they are already dead when the court decides to give them 4 votes.
